法廷の尋問場面における戦略的談話 ― 疑問文の類型を中心に ―

본 연구에서는 법정의 신문장면에서 나타나는 의문문을 대상으로 하여 질문의 목적에 따른 사용양상을 분석했다. 그 결과 ‘긍정의 yes/no의문문’이 가장 많았고 다음으로는 ‘Wh의문문’, ‘평서의문문’의 순으로 나타났다. ‘긍정의 yes/no의문문’은 명제의 진위를 묻는 것이 목적이기 때문에 재판에서 가장 많이 사용되고 있었으며 ‘Wh의문문’은 불명확한 내용을 정확히 이끌어내려는 신문자의 의도로 인해, 평서의문문은 상대에게 확인요구를 하기 위해 사용된다는 특징을 보였다. 한편 의문문을 신문 별로 분석한 결과, 직접신문에서는 ‘Wh의문문’, ‘긍정의 yes/no의문문’, ‘평서의문문’이 특징적이었다. ‘Wh의문문’은 당시 상황을 증인의 시점에서 묻는다는 특징이 있었다. ‘긍정의 yes/no의문문’은 입증해야할 내용을 구체적으로 언급해 증인의 답을 제한함으로써 재판의 흐름을 유리하게 하려는 발화의도가 보였다. 또한 평서의문문에서는 「つまり」를 동반해 주장을 강조하거나 주장에 신빙성을 부여하려는 예가 다수 관찰되었다. 반대신문에서는 ‘긍정의yes/no의문문’, ‘Wh의문문’, ‘부정의yes/no의문문’의 순을 보였다. ‘긍정의yes/no의문문’은 증인의 증언에 대해 결점‧허점을 지적하는 역할을 하고 있었다. 또한 ‘Wh의문문’은 구체적인 답을 요구함으로써 애매한 부분을 명확하게 하기 위해, ‘부정의yes/no의문문’은 증언을 통제하거나 증언에 대한 의외성을 나타내 재판을 유리하게 진행시키려는 전략으로 사용되고 있었다. 평서의문문의 경우 문말에 「よね」를 부가하는 예가 다수 보였는데, 이는 확인하는 어감을 통해 재판의 방향을 자신에게 유리한 쪽으로 흘러가게 하려는 전략으로 볼 수 있다.

This study analyzed the usage patterns of questions according to their purpose, targeting interrogative sentences used during interrogation in the court. It was found that “yes/no questions in positive interrogative sentences” were most frequently used, followed by “wh-interrogative sentences,” and then “declarative questions.” The yes/no questions in positive interrogative sentences were most often used in trials because the purpose of the questions is to highlight the authenticity of the proposition. The wh- interrogative sentences were used with the interrogator’s intention to accurately clear any ambiguity, while the declarative questions were used to ask for confirmation from the other party. Meanwhile, an analysis of interrogative sentences based on the type of interrogation showed that the wh- interrogative sentences, the yes/no questions in positive interrogative sentences, and the declarative questions were mostly used in direct examinations. In cross-examinations, the yes/no questions in positive interrogative sentences were the most frequently ones used, followed by the wh- interrogative sentences, and the yes/no questions in negative interrogative sentences. As a result, all the questions appeared in examinations can be looked on as a strategy to direct the trial in one’s favor.
