일본의 외국인 지방참정권에 대한 법적・정치적 쟁점과 정당의 대응

본 논문의 목적은 일본의 국내적 상황변화와 글로벌 규범의 확산에도 불구하고 외국인 지방참정권이 해결되지 못하는 구조적 한계를 분석하는데 있다. 이를 위해 외국인 지방참정권에 대한 각 정당의 입장과 국회에서의 논의내용을 분석하여 일본에서 외국인 지방참정권의 법제화가 불가능하게 된 원인을 배제적 보수정당 우위체제에 주목하여 규명하였다. 일본에서 외국인 지방참정권 문제는 식민지 시대가 남긴 유산으로 재일한국인・조선인의 권리문제의 성격이 강했다. 그러나 최근 일반 영주자가 증가하면서 이들과 공생이라는 새로운 성격이 중층적으로 추가되었다. 또한, 거주 외국인 형태가 다원화되면서 기존의 근대 국민국가적 국민주권 원리가 한계상황에 봉착하게 되었다. 일본은 헌법에서 외국인 지방참정권을 금지하지 않고 입법에 위임한 상태임에도 불구하고 정당들은 국회에서 법제화하지 못하고 있다. 일본에서 외국인 지방참정권이 법제화되지 못한 원인은 자민당의 근대적 국민주권에 대한 집착이 하나의 원인이다. 또 다른 원인은 국회가 배제적 보수주의를 표방하는 자민당 우위체제에 지배되고 있기 때문이다. 또한 연립여당인 공명당은 자민당을 설득하지 못하고 지지기반을 동원하는 전략으로 외국인 지방참정권을 인식하고 있기 때문이다.

The Right of Foreigners to Vote in Local Elections in Japan

There are two main objectives of the present study. The first one is to investigate the characteristics and dispute issues of the right of foreigners to vote in local election in Japan. The second aim is to look at the positions and policies of each party and analyze why the Diet failed to legalize foreign voting rights. The modern nation-state nationality awareness of the Liberal Democratic Party (LDP) is the reason why the local suffrage of foreigners could not be legalized. The Liberal Democratic Party opposed foreign suffrage in local elections. On the other hand, the Democratic Party and the opposition parties are in favor of foreign suffrage. However, it is difficult to pass the bill because the Liberal Democratic Party is a majority in the Diet. The new Komeito cannot persuade the LDP to support the law. The new Komeito has repeatedly submitted legislative proposals to gain support from its supporters. Since 2012, politics of the conservative Liberal Democratic Party is dominating the Diet. Despite changes in the domestic situation in Japan and progress in globalization, no progress has been made in allowing foreigners to vote in local elections. It is necessary to allow foreigners to vote in local elections at least who are permanent residents with the aim of creating a society which is in harmony with the permanent residents.
