재일디아스포라의 탄생 ― 국적을 둘러싼 법적 해석과 제도의 적용 과정을 중심으로 ―

본고는 패전/해방 후 재일디아스포라가 탄생하게 되는 역사적 배경과 과정을 조선인의 국적(nationality)을 둘러싼 제국/포스트제국 일본의 법적 해석을 비판적으로 검토하면서 논의하였다. 지금까지 재일조선인에 관한 역사학적 연구에서는 일제강점기 조선인의 일본 이주 양상과 재일조선인 공동체의 형성에 관해서 상당 부분 실증적 연구가 진행되었다. 하지만 사실상 재일조선인이 디아스포라가 되는 맥락에는 국적을 비롯한 법적 지위의 부여와, 귀환/재일을 둘러싼 개인의 고뇌와 선택도 중요한 의미를 지닌다. 이에 본고는 병합 이후 조선인에게 부여된 국적을 둘러싼 법적 해석과 제도의 적용 과정, 그리고 일본 이주 양상을 함께 검토하면서 재일디아스포라가 존재하게 된 제도적 연원을 밝히고자 하였다. 제국 일본의 대(對)아시아관이 내포하는 이율배반적인 지향은 필연적으로 병합한 국민(“한국인이었던 일본인”)과 순수한 국민(“일본인이었던 일본인”)을 구별해두는 이중 기준을 처음부터 가져오지 않을 수 없었다. 일본정부가 조선인에게 시행해 가는 국적부여와 호적구분의 과정은 이 같은 ‘국민’의 경계를 명확하게 해두기 위한 제도상의 기제였으며 정책상의 기술이었음을 알 수 있다. 본고의 작업은 최근 국내외 학계에서 개진되고 있는 재일디아스포라 담론을 참조하면서도, 제도사적 관점에서 기존연구를 보완한다는 의의가 있다.

Origin of the Zainichi diaspora : Legal interpretation over nationality and the institutional application process

This paper discusses the historical background and process of formation of the Zainichi diaspora after the defeat/emancipation in the war by critically examining Japan’s empire/post-empire legal interpretation of the nationality of the Chosun people. Up until now, historical research on the Chosun people residing in Japan has been carried out mostly as empirical research concerning aspects of the Chosun people’s relocation to Japan during the Japanese colonial era and the community formed by the Chosun people residing in Japan. As a matter of fact, however, within the context of the diaspora of the Chosun people residing in Japan, not only the provision of the legal status, including nationality, but individuals’ agony and choice around returning to Korea/residing in Japan have crucial meaning. This study examines the process of the legal interpretation of and the application of systems surrounding the nationality assigned to the Chosun people after the annexation in addition to aspects of their relocation to Japan in order to understand the institutional origin of the Zainichi diaspora. This work is significant in that it complements the shortcomings of advanced research from the perspective of institutional history.
