한일회담과 독도 ― 교환공문을 중심으로 ―

전후일본의 독도에 대한 교환공문내용은 한국에 대하여 강력하게 이의를 제기하는 내용들이 주를 이뤘다. 또한 일본은 한국의 독도점령을 비판하고 한국이 독도에서 즉각 철수하고 독도에 세운 등대와 기존에 발행한 독도사진을 담은 우표를 즉각 처분할 것을 요청한다. 그러면서 한국 정부가 독도문제의 평화로운 해결을 위해서는 국제사법재판소에 당해 문제를 회부하자는 일본의 제안에 대해 응하지 않았다는 점에 유감을 표한다. 그리고 일본은 국제사법재판소로부터 독도문제에 대한 판결을 구하는 것이 독도문제해결에 공정하고 적절한 최선의 방법이라는 내용으로 한국을 압박한다. 그러나 한국의 독도에 대한 입장은 일본과 달랐다. 특히 일본의 독도에 대한 국제사법재판소 제소 주장에 대해서 한국은 독도가 역사적으로 한국의 고유영토이다 며 일본의 주장에 맞섰다. 더 나아가서 일본의 고문서와 고지도에도 독도가 일본과 무관하다는 내용이 다수 포함되어 있기 때문에 일본의 독도영유권주장은 맞지 않다. 그리고 17세기말 안용복의 동해상에서의 일본어선 격퇴 활동과 대한제국칙령 41호 문서는 독도가 한국의 고유영토임을 증명하는 결정적 증거이기도 하다. 위의 내용에서 보듯이 이 논문은 일본이 그간 교환공문을 통해서 한국에 독도영유권주장을 해 왔지만 한국과 일본에 있는 고문서등을 종합했을 때 독도는 한국의 고유영토이지 일본의 고유영토가 아님을 알 수 있다.

Korea-Japan Talks and Dokdo : Focusing on Exchange of Notes

The contents of the Japanese exchange of notes on Dokdo after the war mainly comprised phrases that refute the illegal acts of Korea. The Japanese government also criticized Korea's occupation of Dokdo and urged Korea to immediately discontinue using stamps depicting Dokdo Island lighthouses and photos of Dokdo. Regrettably, the South Korean government has not responded to the Japanese government's proposal to refer the matter to the International Court of Justice (ICJ) for a peaceful settlement of the Dokdo issue. The Japanese government is pressuring Korea with the idea that seeking a ruling on the Dokdo issue from the ICJ is the best and fairest way to resolve the Dokdo issue. However, Korea's position on Dokdo is different from that of Japan. In particular, regarding Japan's allegations against Korea at the ICJ on Dokdo, Korea refused to support Japan's claim that Dokdo is historically a Korean territory. Furthermore, Japan's ancient documents and ancient maps contain much information that indicates that Dokdo has no relation to Japan; thus, Japan's claim to Dokdo does not make sense. Furthermore at the end of the 17th century, An Yong Bok's activities on the East Sea and the Korean imperial decree No. 41 were conclusive proof that Dokdo was Korea's own territory. As mentioned above, this paper claims that Japan has been claiming Dokdo as a sovereign territory in Korea by issuing an exchange note, but when we consider ancient documentation in Korea and Japan, we know that Dokdo is an inherent territory of Korea and does not belong to Japan.
